How to Get Your Security Deposit Back

How to Get Your Security Deposit Back with Smart Cleaning Decisions

Moving out of an apartment or other rental property can be a stressful and expensive process, but there are many means of how to get your security deposit back with smart cleaning decisions. Nancie Brown & Associates have worked with tenants for decades to help them save money and time with expert cleaning teams.

Recovering Your Security Deposit

A security deposit is an amount of money that most landlords include as a requirement in a rental agreement, in order to move into a rental property. Typically a security deposit is the same as a month’s rent. It is held in a separate account in order to cover any damages caused by the tenant during their occupancy. Normal wear and tear is not eligible for coverage by the security deposit. In the state of California, a landlord has to return the security deposit to their vacating tenant within 21 days, or send or give the tenant a letter explaining why they are withholding some or all of the deposit to cover damage to the property.

Can My Landlord Keep My Deposit?

In cases where outstanding rent has not been delivered or significant damage has been caused to the rental property during the tenant’s occupancy, a landlord is entitled to withhold some or all of the security deposit. However, they need to inform you of this. If your landlord has not retained your deposit and failed to inform you that they are withholding some or all of your money, they are in breach of California civil law. You are entitled to send a demand letter to retrieve your outstanding security deposit. If this does not succeed in extracting the owed money, you are entitled to go to small claims court to legally recover your security deposit.

Move Out Cleaning Services

Of course, if a landlord needs to have the property cleaned after you move out in order for it to be fit for another tenant to inhabit, the costs of the cleaning will typically be taken out of your deposit. That is why it is best to thoroughly clean your home before you move out. Move in and move out cleaning companies exist to help facilitate the kind of deep cleaning that will satisfy landlords and make the property suitable for new tenants to move in.
